There’s so much irony in this case it’s hilarious.
According to a new hit piece from Rolling Stone, Supreme Court Justice Amy Coney Barrett needs to recuse herself possibly.
Why?
Her husband, Jesse Barrett, is now representing Fox Corporation in a $3 million defamation lawsuit. This situation is raising questions about potential conflicts of interest and the personal benefits that conservative Supreme Court justices may enjoy.
Rolling Stone whines that this means the parent company of Fox News is directly paying the family of a Supreme Court justice. Neither Justice Barrett nor her husband are required to disclose this arrangement. Jesse Barrett is a managing partner at Southbank Legal, which opened its D.C. office—led by Barrett—after his wife joined the Supreme Court.
On the SouthBank Legal website, Jesse Barrett’s list of anonymized cases now includes “represented a prominent media company in a lawsuit alleging defamation.” This new addition joins other white-collar cases on his profile, including defending a Berkshire Hathaway company in an employment discrimination suit and defending an event promoter from fraud claims.
“You don’t hire the spouse of a Supreme Court justice to represent you in major litigation unless (1) you think they’re competent to do so and (2) you don’t foresee going to the Supreme Court where the spouse would have to recuse, and you might really want/need their vote,” constitutional law professor Anthony Michael Kreis wrote on X (formerly Twitter).
But it’s fine for a Joe Biden-donating judge whose daughter is a paid consultant for the Democrat party to oversee a case that could lead to the incarceration of Biden’s top political opponent.

It’s true that Loren Merchan has served as president of Authentic Campaigns, a firm that does digital campaign work like online fundraising, mobile messaging and web design. They work with Democratic political candidates, including some of Trump’s most outspoken opponents.
The firm has scrubbed references to her on its site, so it’s not entirely clear if she is still in this role at the company. Merchan wrote in an August ruling that his daughter was still the company’s president and chief operating officer at that time.
The hypocrisy of the left never ceases to amaze me.
