Pro-life peaceful protestors who prayed and sang hymns at a Tennessee abortion clinic in 2021 could spend up to 11 years behind bars.
The Biden administration’s DOJ is using a law created to target KKK members after the Civil War.
The six activists were not just charged with violating the Freedom of Access to Clinic Entrances (FACE) – which is a misdemeanor charge with fines and a maximum of one year in jail for the first offense – they were also charged with “conspiracy against rights,” which is also known as the “KKK Act.” That charge carries with it a ten-year maximum sentence.
“The KKK Act automatically turns any violation of an underlying law — or if you conspired to violate a federal law — it converts it to a felony,” Thomas More Society Executive Vice President and general counsel Andrew Bath told Breitbart News in an extensive phone interview. “So now you’re facing a felony prosecution, even if your conviction under the FACE Act would’ve been a misdemeanor.”

The Conspiracy Against Rights Act was passed in 1870 after the KKK began terrorizing black citizens who were exercising their right to vote and run for public office. The goal of the act was to end “violence and empower the president to use military force to protect African Americans.”
The law specifically “makes it unlawful for two or more persons to agree to injure, threaten, or intimidate a person in the United States in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States or because of his or her having exercised such a right.”
What’s interesting here is that individuals have no Constitutional right to abortion so the fact that this charge wasn’t thrown out is mind-blowing.
The Biden Administration has vowed to increase FACE Act prosecutions in retribution for the overturning of Roe v. Wade.
“Prior to [Assistant Attorney General for Civil Rights] Kristen Clarke, FACE Act charges were never paired with conspiracy against rights. Since she took over, it’s now standard that if you get charged with the FACE Act, they slap on conspiracy against rights to increase the years from 1 to 11,” Wendt said.
“This is a new trend,” Bath also noted.
